By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service. ## 1\. Eligibility You must be at least 13 years old to use the Service. If you are under 18 (or the age of majority in your jurisdiction), you may only use the Service with the consent of a parent or guardian. You represent that you have the legal capacity to enter into these Terms. ## 2\. The Service MoneyTrees is a research and signal-intelligence tool that aggregates publicly available social and market data and exposes an optional paper-trading interface and AI assistant. The Service is provided for informational and educational purposes only. ## 3\. Not financial, legal, or tax advice Nothing produced by the Service — including signals, rankings, AI-generated responses, agent recommendations, or simulated returns — constitutes investment, financial, legal, accounting, or tax advice. You are solely responsible for your own decisions and should consult a licensed professional for your specific situation. Markets are volatile and you may lose money in any real-world activity informed by the Service. ## 4\. Paper trading only Trades placed through the Service route exclusively to Alpaca’s **paper-trading** environment. The Service does not place orders for live funds. Historical and simulated returns are not predictive of real-world results. The Service is not a registered broker-dealer, investment adviser, or financial institution. ## 5\. Accounts & security You are responsible for activity under your account, including actions taken by AI agents you configure. Do not share credentials. Notify us promptly at [legal@moneytrees.ai](mailto:legal@moneytrees.ai) if you suspect unauthorized access. ## 6\. Acceptable use You agree not to: - Use the Service to engage in market manipulation, fraud, money laundering, or any other illegal activity. - Violate third-party terms that apply to data flowing through the Service — in particular the X [Developer Agreement and Policy](https://developer.x.com/en/developer-terms/agreement-and-policy), the [Google API Services User Data Policy](https://developers.google.com/terms/api-services-user-data-policy), and the terms of any prediction market. - Scrape, mirror, syndicate, resell, or commercially exploit the Service or its data. - Reverse engineer, decompile, or attempt to extract source code from the Service, except where such restriction is prohibited by applicable law. - Probe, scan, load-test, or otherwise attempt to compromise the Service or its infrastructure. - Use the Service to harass, defame, or harm others, or to transmit malware or unlawful content. - Misuse the AI assistant or agents to generate prohibited content under our model providers’ policies (Anthropic, OpenAI, Google). We may suspend or terminate accounts that violate these rules. ## 7\. AI assistant & autonomous agents The in-app assistant and any autonomous agents you enable use third-party large-language-model providers via the Vercel AI Gateway. Output may be inaccurate, incomplete, or out of date. You are responsible for verifying anything you act on. Agents operate strictly within Alpaca’s paper-trading environment. Your content You retain ownership of watchlists, prompts, notes, and other content you submit (“Your Content”). You grant MoneyTrees a worldwide, non-exclusive, royalty-free license to host, process, transmit, and display Your Content solely for the purpose of operating, securing, and improving the Service. This license ends when you delete Your Content or your account, except for backups retained under our retention policy. ## 9\. Intellectual property Apart from Your Content, all rights, title, and interest in and to the Service — including software, design, content, trademarks, and the MoneyTrees name — are owned by MoneyTrees or its licensors. No license is granted to you except as expressly set out in these Terms. ## 10\. Subscriptions, billing, refunds Paid features (when offered) are billed through Stripe on the cadence shown at checkout. Subscriptions renew automatically until cancelled. You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing period. Except where required by law, fees are non-refundable. ## 11\. Termination You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if continued operation would expose us to legal or security risk, or if we discontinue the Service. We will use commercial best efforts to give advance notice where feasible. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, governing law) survive. ## 12\. Warranty disclaimer THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY SIGNAL, RECOMMENDATION, OR FORECAST WILL BE ACCURATE. ## 13\. Limitation of liability TO THE MAXIMUM EXTENT PERMITTED BY LAW, MONEYTREES AND ITS OPERATORS, AGENTS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) US$100. Some jurisdictions do not allow these limitations; in those jurisdictions our liability is limited to the smallest extent permitted by law. ## 14\. Indemnification You agree to defend, indemnify, and hold harmless MoneyTrees and its operators from any claim, demand, loss, or expense (including reasonable attorneys’ fees) arising out of (a) your use of the Service, (b) Your Content, (c) your violation of these Terms, or (d) your violation of any third-party right or applicable law. ## 15\. Dispute resolution — arbitration & class waiver Please read this section carefully — it affects your rights. **Informal resolution.** Before filing a formal claim, you agree to first contact us at [legal@moneytrees.ai](mailto:legal@moneytrees.ai) and attempt to resolve the dispute informally for at least 60 days. **Binding arbitration.** Any unresolved dispute arising out of or relating to the Service or these Terms will be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules. Arbitration will take place in California, USA, unless otherwise agreed. Judgment on the award may be entered in any court of competent jurisdiction. **Class-action waiver.** You and MoneyTrees agree to bring claims only in your individual capacity, not as a plaintiff or class member in any class, collective, or representative action. The arbitrator may not consolidate more than one person’s claims. **Exceptions.** Either party may seek injunctive relief in a court of competent jurisdiction to protect intellectual-property rights or to address unauthorized access. Small-claims-court actions are also permitted. **Opt-out.** You may opt out of this arbitration agreement by emailing [legal@moneytrees.ai](mailto:legal@moneytrees.ai) within 30 days of first accepting these Terms, with the subject line “Arbitration Opt-Out” and your account email. ## 16\. Governing law & venue These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-laws principles. Subject to Section 15, the state and federal courts in San Francisco County, California have exclusive jurisdiction over any dispute not subject to arbitration. ## 17\. International users & export The Service is operated from the United States. You are responsible for compliance with the laws of your jurisdiction. You may not use the Service if you are located in a country subject to United States embargo, or if you are listed on any United States government list of prohibited or restricted parties. ## 18\. Changes We may update these Terms from time to time. Material changes will be announced in-product at least 7 days before they take effect. Continued use after the effective date constitutes acceptance. ## 19\. Miscellaneous - **Entire agreement.** These Terms and our [Privacy Policy](https://moneytrees.ai/privacy) are the entire agreement between you and MoneyTrees regarding the Service. - **Severability.** If any provision is held unenforceable, the remaining provisions remain in effect. - **No waiver.** Failure to enforce any right is not a waiver of it. - **Assignment.** You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets. - **Force majeure.** We are not liable for failure to perform caused by events outside our reasonable control. - **Relationship.** Nothing in these Terms creates an agency, partnership, joint venture, or employment relationship. ## 20\.
